In an effort to “avoid probate,” many people are being advised to create a trust. While it is true that a properly funded trust can avoid probate, it is also true that many less expensive (or free) strategies can be implemented to allow certain assets to pass to heirs without probate court involvement. We understand that estate plans are not “one size fits all.” Every client and every client’s situation is different. And some clients simply do not need the added protection – or the added expense – of creating a trust. If you are young, just starting out, or starting over, a will may be all you need to protect the assets you have.
