Michigan’s Underground Storage Tank and Aboveground Storage Tank Programs Transferred Out of the Department of Environmental Quality

On October 3, 2012, Governor Rick Snyder issued Executive Order 2012-14, which transfers the Underground Storage Tank (UST) program and the Aboveground Storage Tank (AST) program from the Department of Environmental Quality (DEQ) to the Department of Licensing and Regulatory Affairs (LARA) within the Bureau of Fire Services. The intent of these program transfers is to streamline the regulatory and enforcement process and to make the programs more efficient and effective. The directors of DEQ and LARA will work together to facilitate a smooth and coordinated program transfer, to include records, personnel, property, unexpended balances of appropriations, budgets, etc. In the coming weeks, the directors of both departments will develop a memorandum of record to identify any pending settlements, issues of compliance, or other obligations to be resolved.

It is important to note that the Leaking Underground Storage Tank (LUST) program will remain with the DEQ.
